Pilots using mobiles

I was surprised to see the pilot after one of the flights I took recently using his mobile just outside the cabin, as the fuel truck was approaching.

I wouldn't use mine in a petrol station, so aren't there similar regs at airports?

Even when the fuel truck is approaching? Don't think it had started the fill.

a/c was a twotter so no such guidance given to pax, one pax seemed able to pick up FaceB updates en route, I doubt anyone would be daft enough to try and make a call with that noise, but most of the flight was within sight of land and obviously low altitude too.
