What happens if one JAA country approves medical, and other JAA state does not?

I am standing in one situation where I was refused to make class 1 medical in the UK, because pre op laser conditions on one eye.

However I did send the same pre op medical report to another JAA country, and they told me they would approve my class 1 medical.
Now what happens if I want to convert this medical later to UK JAA class 1 medical? It will come up here in the UK that they refused me the class 1 check up.

I talked to the medical chief doctor in the other JAA country, and they saw no reason to not approve me.

I planned to go USA and get Commerical there, UK CAA said they would then most likely approve anyway, however I dont want to get anything to chance, I will go to this other JAA country and get my class 1 medical.
But I was thinking of doing my ATPL theory in the UK, but do I need a class 1 UK medical for this? Or can I use the foreign states class 1 medical?

Also for flight training in the UK? Or might I loose the class 1 medical if UK CAA and other JAA country enter a dispute about their desicion?

Anybody know about this?

actually there is a form and together with 17 UK pounds you can turn your Class 1 to a CAA Class 1.
Just call the girls at the CAA.
I asked because a friend was doing his medical in Greece.
Just remember that this is only possible within active JAA members.

My last reply wasn't so helpful !! so maybe i can help with this one.
I am in a similar problem/concern and am also planning training in USA but this is the first hurdle. But I found a good site for you

and the JAR rules are downloadable:

JAA | Publications & NPAs | JARs Section 1

Download the JAR-FCL 3 (Medical) and read JAR–FCL 3.015 from on one of the (many) lines available. Pretty much says that its ok to transfer.

When in doubt - call the local JAA authority - In UK it's the CAA, and they will tell you how to transfer - I did that and they told me how much$ and some more forms to fill

You need to be very careful when dealing with the CAA and ophthalmological requirements.

It has in the past been the case that if you fail the eye examination in the UK then go to another JAA member state and pass, the CAA may still refuse to exchange the medical for a UK issued medical. This is their standpoint now with colour vision testing - if you fail one of their tests but pass that same test in another member state they will not accept it (a change of policy - they used to accept them); they will only now accept an alternative test. They are against Laser Surgery so this is an area that may meet similar
opposition.

Whatever the reason, you should speak to the CAA first and if they state they would exchange the other member state's Class 1 medical for one of their own then get it in writing. But if you do succeed in this, also watch the time frame and the implementation of EASA Regulation 216 because they could always move the goalposts under the remit that the rules had changed.

What? The CAA move the goalposts? Never!!!

The question and issue here is the pre op report, have given same pre op report to 2 different CAA JAA countries, at more or less same time.

CAA UK said no, but said go via FAA Commerical and good chance they will accept and give class 1 medical.

Other CAA JAA country have read the report differently, and say they are fine with it, ok I do have a prior history with the other CAA as they previously issued me a class2 medical many years ago.

With CAA UK I did not go for any examination, just sent pre op letter.

I have not lied to either of the CAA's, it's just that they have read it differently. Of course all troubles can be avoided if I do my training and conversions outside the UK, or/and I anyway plan to take FAA Commercial, so will plan to have FAA Commerical and JAA class 1 medical from other country. My initial mistake was that I contacted the CAA UK first.

The other CAA JAA, would NOT have accepted FAA Commercial if they initially refused me, so it shows, you can't have it both ways.
What worries me is that potenially I request change to Class 1 UK, and there will open a dispute between the 2 JAA countries, which will leave me in the middle, if it turns out that one of the JAA countries have made a mistake, will that mean they can revoke my class 1 medical?
Which to be honest is crazy on the grounds of pre op limits, which are accepted in most parts of the world, except the JAA countries.

Another question is the following, if I have a class 1 medical from any other JAA country, would I need to change to be able to fly or train in the UK, one would have thought the whole point of the medical would be that it would cover all the countries included.

I think that for license issue you usually have to have a medical from that country. Most airlines do not mind what JAA state your medical is from but the odd ones do. In fact some airlines make you undertake a medical with there own doctor before employment.
