When overload problem have is ıt legal to reduce contıngecy fuel???

Acc.to jar ops.contıngency fuel can be taken maxımum %5 mınımum %3 of trıp fuel.when the company chose %5 for each cfpl.but reducıng contıngency fuel from %5 to %3 when overload problem have.ıs ıt legal.???

When planning with an enroute alternative airfield you reduce the minimum contingency fuel to 3%.
